These Terms of Service ("Terms") govern your access to and use of the website located at [jv10academy.com](https://jv10academy.com) (the "Site"), operated by JV10 Academy ("JV10 Academy," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

These Terms apply to the public-facing website only. The JV10 Academy mobile and desktop application is governed by a separate end-user license agreement and privacy policy presented inside the application.

## 1. Eligibility

The Site is intended for use by adults who are at least eighteen (18) years of age. By using the Site, you represent that you meet this requirement. If you are accessing the Site on behalf of a minor (for example, to register a child for one of our programs), you represent that you are the minor's parent or legal guardian and that you have the authority to act on the minor's behalf.

## 2. Description of the Site

The Site provides information about JV10 Academy's programs, training services, schedules, staff, and registration pathways. The Site may link to or initiate registration in the JV10 Academy application, where actual enrollment, waivers, payments, and communications take place.

We may add, change, suspend, or remove any feature, content, or service on the Site at any time without notice.

## 3. Account Registration

The Site itself does not require an account. If a feature on the Site requires you to create an account or submit information (for example, a contact form or newsletter signup), you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding any credentials you create and for all activity under your submission.

## 4. Acceptable Use

You agree not to:

- Use the Site for any unlawful purpose or in violation of any applicable federal, state, or local law of the United States or the State of Georgia.

- Attempt to gain unauthorized access to the Site, its servers, related systems, or any user account or data.

- Probe, scan, or test the vulnerability of the Site, or breach any security or authentication measures.

- Use any robot, scraper, crawler, or automated means to access the Site, except for well-behaved indexing by public search engines.

- Interfere with or disrupt the integrity or performance of the Site, including by transmitting viruses, malware, or other harmful code.

- Reverse engineer, decompile, or attempt to extract the source code of any software made available through the Site, except where this restriction is prohibited by law.

- Use the Site to harass, abuse, defame, or threaten any person, or to upload content that is unlawful, infringing, or otherwise objectionable.

- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

- Use the Site to collect or harvest personal information about other users.

## 5. Intellectual Property

All content on the Site, including text, graphics, logos, photographs, video, audio, training materials, software, and the selection and arrangement of that content, is owned by JV10 Academy or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, revocable, non-exclusive, non-transferable license to access and view the Site for personal, non-commercial use. You may not copy, reproduce, distribute, publish, display, perform, modify, create derivative works from, sell, or otherwise exploit any portion of the Site without our prior written permission.

"JV10 Academy," the JV10 Academy logo, and other names, marks, and logos on the Site are trademarks of JV10 Academy. You may not use them without our prior written consent.

## 6. Submissions and User Content

If you submit any content to the Site (for example, through a contact form, comment, or testimonial), you grant JV10 Academy a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, publish, and display that content in connection with our programs and business operations. You represent that you own or have all necessary rights to the content you submit and that it does not violate the rights of any third party.

We are not obligated to publish, retain, or respond to any submission and may remove any submission at any time and for any reason.

## 7. Programs, Registration, and Payment

Any registration, enrollment, scheduling, or payment offered or referenced on the Site is subject to the additional terms, waivers, and disclosures presented at the point of registration (including inside the JV10 Academy application). In the event of a conflict between these Terms and the program-specific terms, the program-specific terms control with respect to that program.

## 8. Links to Third-Party Sites

The Site may contain links to websites, services, or resources operated by third parties. We do not control those third parties and are not responsible for their content, policies, or practices. Your use of any third-party site is at your own risk and is subject to that third party's terms and privacy policy.

## 9. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, JV10 ACADEMY DISCLAIMS ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED. ANY INFORMATION ON THE SITE IS PROVIDED FOR GENERAL INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE, INCLUDING MEDICAL, LEGAL, OR FINANCIAL ADVICE.

## 10. Assumption of Risk

Athletic training and youth sports programs involve inherent physical risks. The Site provides general information about our programs; it does not itself create any duty of care, and access to the Site does not enroll any person in a program. All risk acknowledgments, waivers, and releases applicable to participation in JV10 Academy programs are presented and collected separately at the time of registration.

## 11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL JV10 ACADEMY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT JV10 ACADEMY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL JV10 ACADEMY'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

## 12. Indemnification

You agree to defend, indemnify, and hold harmless JV10 Academy and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

## 13. Termination

We may suspend or terminate your access to the Site at any time, with or without cause, and with or without notice. Upon termination, your right to use the Site immediately ceases. The sections that by their nature should survive termination (including Sections 5, 6, 9, 10, 11, 12, 14, 15, and 16) will survive.

## 14. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on the Site, with the "Last updated" date at the top. Material changes will be flagged conspicuously. Your continued use of the Site after the revised Terms take effect constitutes your acceptance of those changes.

## 15. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. You agree that any action at law or in equity arising out of or relating to these Terms or the Site that is not subject to arbitration (if any) will be filed exclusively in the state or federal courts located in the State of Georgia, and you consent and submit to the personal jurisdiction of those courts.

## 16. Miscellaneous

- Entire agreement. These Terms, together with any program-specific terms and our [Privacy Policy](./privacy-policy.md), constitute the entire agreement between you and JV10 Academy regarding the Site.

- Severability. If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.

- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms freely.

- No agency. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship.

- Headings. Section headings are for convenience only and have no legal effect.
